Pursuant to S.I. No.418/2011 - Finance (Transfer of Departmental Administration and Ministerial Functions) Order 2011 the Respondent in all Garda Compensation Special Summons is now the Minister for Public Expenditure and Reform. The effective date of this Order is 29th July 2011. References to the Minister for Finance shall from the commencement date of this order be construed as references to the Minister for Public Expenditure and Reform. New Summons issued in Garda proceedings should name the Minister for Public Expenditure and Reform as the Respondent.

Garda Compensation Special Summons appear in the Master's List on Wednesdays for purely procedural reasons. The Master no longer assigns dates to such cases. The practice is that all such cases are automatically transferred to the Garda Compensation list. They are not called in the master's list and there is no need for practitioners to attend in respect of the listing.

Once automatically transferred into the Garda Compensation list, the summons will sit in the list until the plaintiff's solicitor and the chief state solicitor agree that the case is ready to go on. When this agreement has been reached, the Plaintiff can apply on any Monday (on notice to the State) to the list for a date for hearing

Consent applications for hearing dates will be taken after the call over. Practitioners should complete hearing date application forms (available from the Registrar) in advance of the court sitting.

Where a date is fixed papers (copy affidavits reports etc) must be lodged at the public desk in the Central Office no later than the Tuesday before the assigned hearing date. Papers should be marked for the attention of the Garda Compensation Registrar.
